Terms and conditions of use below regulate the rules of purchasing goods in our online shop. By making an order you acknowledge that you agree to all terms and conditions described in this document.

 

General rules.

 

Online shop E-CLEMATIS is an online retail business.

All goods offered by E-CLEMATIS are legal on Polish market.

All prices given on our website are brutto prices (including VAT). They do not include the postage. The price displayed next to the icon of a plant is the final and binding price customers pay for the plant while making their order.

We deserve the right to change the price of all advertised goods with the exception of these already purchased and the right to withdraw some goods from our offer.

Information on our website is not an offer according to the Civil Code. By making an order through our website customers agree to buy a product according to conditions described in the product description.

We issue receipts for all goods sold in our online shop. All data required for a VAT invoice can be given while making an order or by sending an e-mail to us.

By making and confirming your order you agree to our Terms and Conditions of Use, you confirm the voluntary purchase of our goods and you agree to process your data for our business purposes only.

Our website is protected by SSL (Secure Socket Layer) certificate, a guarantee of safe shopping.

We are committed to complying with the Data Protection Act of the 29th August, 1997. According to the Act the customers agree to store and process their personal data for marketing and business purposes only. The customers have the right to view, correct and stop us using information we hold on them.

We deserve the right to assess and cancell the order in exceptional cases of justified inability to fulfill it.

Making an order.

 

Making an order (more details in HOW TO BUY section) in E-CLEMATIS is easy. All customers are required to do is to add chosen goods from our stock to your cart, choose the delivery options and method of payment. 

The next step is logging into your account on our website. If you do not have an account you can register your details with us or choose an option of shopping without the registartion.

After making your order you will receive an e-mail confirmation with the details of your order and information essential to its completion. If you do not receive this message within 24 hours please contact us immediately by e-mail or phone.

We update you on the progress of your order by e-mails titled ‘your order status’.

 

Methods of payment.

 

Money transfer – you make a payment for purchased goods to our bank account. It is essential to provide your order number and your name in the transfer title in order to make the identification of the payment easier. The failure to do so and making a mistake can cause delay or cancellation of your order.

Delivery rules.

 

We deliver the plants between 15th March and 15th November on ‘first come first served’ basis. The delivery period may change if the weather conditions such as frost, snow or heavy rain make it unsafe.

Our plants are dispatched in a very secure way in order to be delivered in good condition to our customers.

The maximum weight of plants included in one package is 36kg. If the total weight of plants is more than 36kg and less than 72kg it is necessary to dispatch them in two packages. In case of the total weight of plants being more than 72kg we will dispatch three packages.

The plants weight can be found in the product description. Our computer system adds up the wieght of individual plants for the delivery and calculates the total amount of the delivery charge.

 

In case of deliveries to the EU countries the delivery charge depends on the weight of the package and EU area of the counrty of destination.

Time of order completion.

The time required to complete your order includes:

  • time of collecting ordered plants – in case of non-availability of some

  • time until we receive your payment to our account – in case of money transfers

  • time of packaging and preparing plants for the dispatch

  • time required to deliver your order by a delivery company

On average it takes from one to three days to complete the order. We deserve the right to extend this period of time to seven days in case of experiencing extremely busy time for our business.However, we will make every effort to make this period of time as short as possible.

Due to taking extreme care of our plants, we dispatch the orders on Mondays, Tuesdays, Wednesdays and, after pre-arranged agreements, on Thursdays as well – provided that these are working days and not holidays or bank holidays. Your items are delivered by a delivery company within one working day.

Important!

Please provide a delivery address that will be the most convenient for the pick up (e.g. home address, work address, or the address of a family member or a neighbour) together with a relevant telephone number so we can contact you in case of any problems with your delivery.

Providing incorrect details for the delivery (your address or telephone number) may cause it impossible to deliver your goods. In this case you will be charged for extra costs of additional delivery as we do not take responsibility for the mistakes you may have made in the order form. However, if you provide corrected details of your delivery before we dispatch your order, there will be no extra charge imposed.

Returns and refunds.

Customers have the right to return their goods without any question asked. However, it is required to do so within seven days from the delivery of the order. The plants should be sent securely to us, be in good condition and in their original packaging. Customers meet the cost of the return delivery.

We will not pay for the return delivery when we receive it. We will refund the amount you paid for your plants (except the delivery charge!) to your account within seven days from receiving the returned package.

 

Complaints.

We do not take responsibility for the delayed delivery of your order. It is the responsibility of the delivery company.

It is advised and required to check the delivered package before it is signed for in order to see if any plants have been damaged in the delivery. This needs to be done in the presence of the delivery driver. Especially, please check the tape around the package very carefully as its damage might signify the damage of your goods. In case of your delivered plants being damaged you need to make a damaged goods report with the delivery driver. The report should include the date and time of the delivery and the description of the damage. The report with the signature of the delivery driver is essential to resolve any complaints you may have about damaged plants in your delivery. Should you wish to complain about plants delivered in bad condition you are required to contact us immediately to resolve the matter as soon as possible.

 

Complaints about the colour of the flowers are not taken into consideration as the colour of the flowers in photos on our website and on the labels might be slightly different than the colour of flowers in reality. It is due to the individual settings of the computer screen, the light conditions when the photo was taken and also to the microclimate and conditions of growing like: light (in the sunny or shadowy place), temperature, humidity, fertility and acidity of the soil or kind of sprouts (last year’s or this year’s).

Perennial plants, perennial clematis ans texan clematis in the early spring time are clipped right over the ground and they only start to sprout and grow. This is why, the appearance of plants ordered at this time cannot be a subject of complaints.

Complaints will be resolved individually after receiving a notification of a problem with its relevant description and, if applicable, the photos of the plants.

We resolve the dispute within seven working days from receiving the complaint. You will be notified about our decision and arrangements to end the dispute by e-mail or telephone.
